Nobody adds lead to a lipstick on purpose. It shows up as a trace contaminant, usually riding in on a mineral pigment or a clay that was pulled out of the ground somewhere and never fully purified. That's the part of the Hotlist that trips people up: it isn't only a list of banned intentional ingredients, it's also a set of impurity limits for things you never meant to include.
Two different problems, one list
The Cosmetic Ingredient Hotlist covers two separate situations that get lumped together in people's heads.
The first is an ingredient you chose deliberately. If you formulated with a prohibited substance, that's a straightforward fix: take it out, reformulate, move on.
The second is a contaminant that arrived attached to something else. Lead in a mica-based pigment. Arsenic in a bentonite clay. Trace metals in a botanical extract grown in soil that had its own history. Nobody put them there. They came along for the ride, and the question becomes whether the level present is low enough to be treated as an unavoidable trace rather than a violation.
This is why heavy metals get handled through technical limits rather than a flat ban. A total prohibition on lead would end the use of most natural mineral colorants overnight, which isn't the intent. Instead there's a tolerance built around what's realistically achievable with careful sourcing and processing, not what's zero.
Why colorants and clays get the most scrutiny
Mineral pigments (the iron oxides, ultramarines, and micas common in color cosmetics) and cosmetic clays (kaolin, bentonite, rhassoul) are the categories most likely to carry trace heavy metals, simply because they're mined rather than synthesized. A synthetic surfactant made in a reactor has a much more controlled impurity profile than a clay dug out of a specific deposit.
If your product line leans on:
- Natural mineral pigments in makeup (blushes, eyeshadows, mineral foundations)
- Clay masks or clay-based cleansers
- Any ingredient marketed as "natural earth pigment" or "raw mineral"
these are exactly the places to ask your supplier for heavy metal data, not because you're accused of anything, but because this is where the actual risk in the supply chain sits.
What to actually ask your supplier for
A certificate of analysis (COA) for a mineral or clay ingredient should report heavy metal content directly, usually as parts per million (ppm) for lead, arsenic, mercury, and sometimes cadmium and antimony. If your supplier can't produce this, that's worth pausing on before you commit to that ingredient for a commercial batch.

If you're formulating with a synthetic-only ingredient list, this is much less of a concern. It's the natural, mined, and mineral-derived ingredients where heavy metal impurities are a real formulation variable rather than a theoretical one.
What this means for your filing

Heavy metal impurities in a mineral pigment aren't something you add as a separate line item, since they're not an intentional ingredient. A few practical habits that save headaches later:
- Keep supplier COAs on file for every mineral, clay, or mined ingredient, not just the synthetic ones.
- Re-check documentation when you switch suppliers for the same INCI name, since impurity profiles aren't guaranteed to match across sources.
- Don't assume "natural" means "clean." Natural materials are exactly where impurity screening matters most.
