Self-Tanner DHA and the Cosmetic Notification It Needs

Dihydroxyacetone is one of the more interesting ingredients to file a notification for, because it does something genuinely chemical, it reacts with amino acids in the skin's outer layer to produce a browning effect, and yet it stays squarely in cosmetic territory rather than drug territory, as long as you keep the claims where they belong.

Why DHA doesn't trip into drug classification

The distinction that keeps sunscreen out of the cosmetic category is that sunscreen claims to protect against or prevent a condition (sun damage, burning), which is treated as a drug function. DHA-based self-tanners don't make that kind of protective or preventive claim. The reaction that produces color is a surface-level cosmetic effect on the skin's appearance, not a claim to treat, prevent, or cure anything, so it stays cosmetic.

This is exactly why self-tanner labels are so careful never to imply any sun protection benefit. A self-tanner that colors skin has no actual SPF value on its own, and any label or marketing suggestion that a tan from DHA offers sun protection would be both inaccurate and a step toward drug-claim territory that the product's actual chemistry doesn't support.

What goes on the Cosmetic Notification Form

Filing a self-tanner in Canada follows the same core CNF process as any other cosmetic: file through the Cosmetic Notification System within 10 days of first sale, list every ingredient by INCI name with concentration or a concentration range, and you'll receive a Cosmetic Notification (CN) number once it's processed as a notification rather than a pre-market approval.

For DHA specifically, a few details are worth getting right:

  • List Dihydroxyacetone as the INCI name, not a trade name some suppliers use for their tanning-active blends
  • If DHA is delivered to you as part of a supplier blend with stabilizers or pH adjusters, break the blend into its actual components and calculate DHA's real concentration in your finished product by multiplying the component percentage by the blend's use level in your formula
  • Note the concentration accurately, since self-tanning formulas vary widely in DHA strength depending on the intended depth of color, and an imprecise range on the filing is a common source of follow-up questions

Watch the accompanying formula, not just the DHA

Self-tanners often carry a fragrance system to mask DHA's characteristic scent, and depending on your CNF filing timeline, that fragrance blend may fall under the fragrance allergen disclosure rules that are becoming mandatory on Canadian filings. A self-tanner is typically a leave-on product, which means fragrance allergens present above roughly 0.001% need to be disclosed once those requirements apply to your filing, so don't treat DHA as the only ingredient worth double-checking in a self-tanner formula.

Claims to avoid on the label

Keep the marketing copy anchored to appearance: "develops a natural-looking tan," "gradual color buildup," "bronzing effect." Avoid any language suggesting protection from UV exposure, prevention of sunburn, or a health benefit tied to the tanning process itself.
