When a Common Ingredient Becomes Restricted Above a Set Level

How concentration-triggered restriction works, where an everyday ingredient is fine at low use rates but crosses into restricted territory past a threshold.

An ingredient can be perfectly fine in your formula on Monday and a compliance problem on Tuesday, without you changing your supplier or your process at all. All it takes is nudging the use rate up half a percent for a reformulation, and suddenly you've crossed a line that was invisible until you actually did the math.

Restriction isn't always a yes or no question

People tend to think of a restricted ingredients list as a blacklist, things you either use or don't. In practice, a lot of the entries on Canada's Cosmetic Ingredient Hotlist aren't outright prohibited, they're capped. The substance is permitted, but only up to a defined concentration, sometimes only in specific product categories, sometimes with additional conditions like required warnings.

That structure exists because toxicology usually isn't binary either. A preservative that's safe at 0.3% might carry real risk at 3%. An exfoliating acid that's gentle at a low percentage can be aggressive at a high one. The Hotlist reflects that reality by setting a ceiling rather than a flat ban for a large share of its restricted entries.

Why this catches makers off guard

The trap is usually one of these scenarios:

  • A reformulation bumps up an active. You increase a botanical extract or acid from 2% to 5% to get a stronger effect, without rechecking whether that extract's active constituent has a concentration cap.
  • A supplier blend hides the real number. You're using a supplier's proprietary complex at 3% of your formula, but that complex is itself 40% of a restricted compound, so the real finished-product concentration is higher than it looks at a glance.
  • Multiple ingredients contribute to the same restricted substance. Two different raw materials in your formula might both contain trace amounts of the same restricted compound, and neither alone crosses the threshold, but combined they do.

None of these show up if you're just eyeballing your ingredient deck. They show up when you actually calculate concentration ingredient by ingredient and compare each one against its Hotlist entry.

Doing the blend-expansion math correctly

This is the same principle that applies to fragrance allergens, and it applies just as much to any restricted active hiding inside a supplier blend. If a blend is 3% of your total formula, and the restricted compound is 40% of that blend by weight, the finished-product concentration is 3% times 40%, which is 1.2%, not 3% and not 40%. Skipping this step is the single most common reason a maker misjudges where they actually sit relative to a limit.

2. Get the compound's percentage within the blend Not the blend's percentage in your formula
3. Get your use rate of the blend in the finished product The percentage on your formula sheet
4. Multiply the two percentages together This gives the real finished-product concentration
5. Compare against the current Hotlist limit Confirm you're checking the latest published limit, not a remembered one

The limits move too

Concentration caps aren't set in stone forever. The Hotlist gets updated as new safety data becomes available, and a limit that was fine last year can tighten. This means a formula that passed review eighteen months ago isn't guaranteed to still pass today, especially for ingredient categories that get regular scientific reassessment. Building a habit of rechecking active ingredient concentrations against the current Hotlist, not just at initial filing but at every reformulation, is the difference between catching a problem yourself and having a regulator or retailer catch it for you.

What to do with this in practice

If you're adjusting a formula, even a small tweak to boost efficacy or change texture, treat any change to an active ingredient's percentage as a trigger to recheck its Hotlist status, not just its overall safety in your own testing. And if you're using supplier blends, don't take the label percentage at face value. Ask for the internal breakdown, do the multiplication, and record the real number in your formula documentation so you're not redoing this calculation from memory every time.
